Standard terms, conditions, and operational guidelines governing the use of XOOM Transglobal Logistics services and digital platform.

XOOM Transglobal Logistics L.L.C.

These Terms of Use govern all freight forwarding, warehousing, customs brokerage, and tracking services provided by XOOM Transglobal Logistics L.L.C. in Dubai, UAE.

1. Overview & Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you or the corporate entity you represent ("Customer", "User", or "you") and XOOM Transglobal Logistics L.L.C. ("XOOM TGL", "we", "us", or "our"), a company incorporated in Dubai, United Arab Emirates and part of XOOM Group.

By accessing our website (xoomtgl.com), submitting a Request for Quote (RFQ), booking freight movements, or using our tracking portals, you acknowledge that you have read, understood, and agree to be bound by these Terms along with our Privacy Policy and Cookie Policy.

2. Scope of Logistics & Digital Services

XOOM TGL provides tech-enabled multi-modal freight forwarding, contract warehousing, cross-border customs clearance, e-commerce fulfillment, and supply chain tracking from Dubai, UAE. The following operational parameters apply:

  • Freight Brokerage & Forwarding: We act as an authorized freight forwarder and logistics intermediary coordinating air, ocean, and overland freight movements in accordance with applicable UAE transport laws.
  • Warehousing & Storage: Secure bonded and non-bonded warehousing, pallet storage, pick-pack fulfillment, and inventory handling at our Dubai Investment Park (DIP 1) hub.
  • Customs Clearance & Brokerage: Cross-border documentation, duty processing, and regulatory declaration compliance under UAE Federal Customs Authority regulations.
  • Digital Visibility & Tracking: Real-time milestone updates, container tracking, and customer portal interfaces provided for operational transparency.

3. Quotations, Rate Estimates & Bookings

Rate estimates, preliminary quotations, and tariff calculations provided through our website or RFQ forms are indicative and based on customer-declared cargo specifications, prevailing fuel surcharges, carrier tariffs, and customs rates at the time of inquiry.

A booking only becomes binding upon issuance of a formal written Booking Confirmation, Master Services Agreement (MSA), or standard Bill of Lading / Air Waybill issued by XOOM TGL or its designated carriers.

  • Quotations remain valid for 14 calendar days from the date of issuance unless explicitly stated otherwise in writing.
  • Rate quotes exclude unexpected port demurrage, customs detention, government inspections, or special handling fees unless specifically included.
  • XOOM TGL reserves the right to adjust final invoiced rates if actual cargo dimensions, weights, or classifications differ from initial RFQ declarations.

4. Customer Obligations & Prohibited Cargo

Customers represent and warrant that all cargo tendered to XOOM TGL is properly packaged, accurately labeled, and complies fully with UAE customs regulations, international trade laws, and destination import restrictions. The following cargo types are strictly prohibited unless prior written authorization is issued:

  • Illegal or Controlled Substances: Narcotics, unlicensed pharmaceuticals, counterfeit goods, or goods violating intellectual property rights.
  • Hazardous & Undeclared Dangerous Goods: Explosives, radioactive materials, flammables, or hazardous chemicals not declared in strict compliance with IATA/IMDG regulations.
  • Weapons & Munitions: Firearms, ammunition, tactical gear, or restricted dual-use goods without official UAE Ministry of Defence / Ministry of Interior clearances.
  • Perishables & Live Animals: Unapproved perishable biologicals, livestock, or temperature-sensitive items without certified cold-chain booking agreements.

5. Commercial & Payment Terms

All invoices issued by XOOM TGL are payable in United Arab Emirates Dirhams (AED) or agreed convertible currencies according to the commercial credit terms agreed upon in the Customer's account agreement.

Applicable Value Added Tax (VAT) will be charged in compliance with UAE Federal Tax Authority (FTA) laws. XOOM TGL maintains a general possessory lien on all cargo, documents, and assets in its possession until all outstanding freight, storage, and handling charges are settled in full.

6. Limitation of Liability & Cargo Claims

XOOM TGL exercises reasonable care and professional diligence in all logistics operations. However, our liability for loss, damage, or delay to cargo is limited in accordance with the UAE Commercial Transactions Law (Federal Decree-Law No. 50 of 2022) and the UAE Commercial Maritime Law (Federal Decree-Law No. 43 of 2023), or applicable international transport conventions (Warsaw/Montreal Convention for air freight; Hague-Visby Rules for ocean freight; CMR for road freight).

Customers are strongly advised to secure comprehensive Marine Cargo Insurance covering the full commercial value of goods in transit. XOOM TGL is not liable for consequential loss, lost profits, business interruption, or events of Force Majeure (including extreme weather, port closures, geopolitical disruptions, or acts of state).

7. Intellectual Property & Platform Usage

All logos, trademarks, software code, tracking dashboard interfaces, text, graphics, and multimedia assets on xoomtgl.com are the proprietary intellectual property of XOOM Transglobal Logistics L.L.C. and XOOM Group.

You may not copy, reproduce, scrape, reverse engineer, or redistribute any platform content or interface without express written authorization from XOOM TGL management.

8. Governing Law and Dispute Resolution

These Terms of Use, their interpretation, and any disputes arising out of or in connection with our services shall be governed by and construed in accordance with the laws of the United Arab Emirates as applied in the Emirate of Dubai.

Any dispute, controversy, or claim arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent Courts of the Emirate of Dubai, United Arab Emirates.
